Most people assume workers’ compensation is basically just medical bill coverage. It’s more than that. New York’s system provides a broader range of benefits than many injured workers ever realize, and not knowing what you’re entitled to can mean leaving real money on the table.

Medical Benefits

All necessary and reasonable medical treatment related to your workplace injury is covered. That includes:

  • Emergency treatment immediately following the injury
  • Ongoing care from authorized treating physicians
  • Specialist referrals when medically necessary
  • Prescription medications related to the injury
  • Physical therapy and rehabilitation
  • Surgical procedures when required
  • Medical equipment like braces or assistive devices

There’s no cap on medical benefits in New York workers’ comp cases. As long as treatment is necessary and causally connected to the work injury, it should be covered. Carriers can and do challenge whether specific treatments qualify, which is exactly why thorough medical documentation matters so much from day one.

Wage Replacement Benefits

Can’t work because of your injury? Your earning capacity took a hit? New York provides wage replacement benefits based on your average weekly wage and your disability classification. There are four categories:

Temporary total disability. You can’t work at all while recovering. Benefits equal two-thirds of your average weekly wage up to the state maximum.

Temporary partial disability. You’re working in a limited capacity but earning less than before. Benefits cover two-thirds of the difference between your pre-injury wage and your current earning capacity.

Permanent total disability. Your injury permanently prevents any gainful employment. Benefits continue for life.

Permanent partial disability. Lasting limitations affect your ability to work but don’t eliminate it entirely. Benefit calculations depend on the specific body part affected and the degree of impairment.

Under New York Workers’ Compensation Law, average weekly wage calculations look at your earnings in the 52 weeks prior to the injury. Getting that number right matters because it drives every wage replacement payment you’ll receive.

Schedule Loss of Use Awards

For permanent injuries affecting specific body parts, New York provides schedule loss of use awards. These are lump sum payments calculated based on the percentage of loss of use of the affected body part and a statutory number of weeks assigned to that part. A significant permanent injury to a hand, arm, leg, or other scheduled body part can result in a meaningful award even after you’ve returned to work. People don’t always know this exists until someone tells them.

Death Benefits

When a workplace injury or occupational illness results in death, surviving dependents can receive weekly benefits based on the deceased worker’s average weekly wage. Burial expenses are also covered up to a statutory maximum. It’s a difficult thing to think about, but families deserve to know these benefits exist.

Vocational Rehabilitation

If your injury prevents you from returning to your previous occupation, you may be entitled to vocational rehabilitation services including job training, education assistance, and job placement support. It won’t undo what happened, but it can open doors that the injury seemed to close.

Getting What You’re Actually Owed

Knowing what you’re entitled to is step one. Actually receiving it is a different challenge. Insurance carriers have financial incentives to minimize benefit payments, misclassify disability levels, and dispute medical treatment. That’s not a cynical take. It’s just how the system works.
